Representante Especial felicita al Gobierno de Chile por aprobación de Ley de maltrato contra niños, niñas y adolescentes, y personas en situación de discapacidad

La Representante Especial del Secretario General Sra. Marta Santos Pais, saluda con mucha satisfacción la aprobación en último trámite constitucional por parte del Senado de Chile, de la “Ley de maltrato contra niños, niñas y adolescentes, adultos mayores y personas en situación de discapacidad.”

Esta nueva ley establece que basta un acto de maltrato corporal único “relevante” para que se configure un delito, diferenciándose del maltrato habitual que regula la ley de violencia intrafamiliar ya vigente en el país, sin exigir que el maltrato cause un daño (resultado de lesión corporal) en la integridad física de la víctima.

La ley sanciona aquellos casos de violencia que no producen lesión. Además, este proyecto de ley sanciona al que somete a alguna de las personas ya mencionadas a un trato degradante menoscabando gravemente su dignidad con pena de presidio menor en su grado mínimo (61 a 540 días).

I. Introduction

1. In the present report, the Special Representative of the Secretary-General on Violence against Children reviews key developments promoted at the global, regional and national levels to enhance the protection of children from violence.

2. The Special Representative is guided by General Assembly resolution 62/141, in which the Assembly established the mandate, and acts as a bridge builder and a global, independent advocate for the prevention and elimination of all forms of violence against children. In its resolution 70/137, the Assembly expressed support for the work of the Special Representative and recommended that the Secretary-General extend the mandate for a further period of three years, and maintain support for the effective and independent performance and sustainability of the mandate, funded from the regular budget.

Los días 28 y 29 de noviembre, en Santiago de Chile, la Representante Especial del Secretario General de la ONU, Marta Santos Pais co-organizó con el Ministerio del Interior y Seguridad Pública, Ministerio de Justicia y Derechos Humanos; el Consejo Nacional de la Infancia (Gobierno de Chile) e el Fondo de Naciones Unidas para la Infancia (UNICEF) una conferencia internacional sobre prevención del delito y reinserción social de niños en contacto con la ley penal. La conferencia fue patrocinada por la Oficina de las Naciones Unidas contra las Drogas y el Delito (UNODC) e el Observatorio Internacional de Justicia Juvenil (OIJJ).

Protection of children from armed violence in the community

1. Introduction

Armed violence in the community compromises children’s rights and is associated with serious risks for their
development and safety, causing children to be injured, disabled, traumatized, exploited, orphaned, imprisoned and at times killed. Living in a community affected by armed violence has consequences for children who are targeted as well as those who witness or feel threatened by such an environment. Armed violence disrupts social harmony and family life, interrupts schooling, compromises health care, undermines economic development and generates fear which limits children’s ability to move freely, participate in
the life of their community, enjoy childhood and develop as empowered citizens.

Pursuant to General Assembly resolution 70/137, the present report of the Special Representative of the Secretary-General on Violence against Children provides an overview of major initiatives and developments to sustain and scale up efforts to safeguard children’s freedom from violence. The report builds on the 2030 Agenda for Sustainable Development and its target to end all forms of violence against children, and on the commemoration in 2016 of the tenth anniversary of the submission to the Assembly of the United Nations study on violence against children.
 

Protecting children from bullying - Report of the Secretary-General

The present report of the Secretary-General, submitted in response to General Assembly resolution 69/158, addresses the prevalence of bullying and its impact on children’s rights, reviews measures adopted by Member States and other stakeholders to prevent and respond to this phenomenon, identifies good practices and provides guidance on priority actions to ensure children’s protection from bullying, including cyberbullying.

Expresses support for the work of the Special Representative of the Secretary-General on Violence against Children, and recognizes the progress achieved since the establishment of her mandate in promoting the prevention and elimination of all forms of violence against children in all regions and in advancing the implementation of the recommendations of the United Nations study on violence against children, including through her regional and thematic consultations and field missions, and thematic reports addressing emerging concerns;

Representante Especial Santos Pais organiza Seminario Internacional en Argentina sobre niñas, niños y adolescentes privados de libertad

Los días 19 y 20 de mayo se realizó en Buenos Aires Argentina el Seminario Internacional “Sistemas de Supervisión y Monitoreo de Condiciones de Privación de Libertad de Niñas, Niños y Adolescentes en Conflicto con la Ley Penal”. Esta actividad fue co-organizada por UNICEF Argentina y la Oficina de la Representante Especial del Secretario General sobre Violencia contra los Niños y se enmarca como un aporte concreto al proceso de elaboración del Estudio Global sobre Niños Privados de Libertad encomendado por el Secretario General de Naciones Unidas.
